Dear Broker

We are introducing a number of new and revised inclusions to our Commercial Motor Policy wordings (Van Product (MZ), Commercial Motor (MV), Motor Fleet (MF) and Motor Trade (MT)), which will take effect from 1st August 2019. These changes apply to both new and renewal Van and Commercial Motor policies written on or after that date and are in line with our strategy to continually review our policy wordings.

Some of the key changes to the policy wordings are noted below:

  • Introduction of a new limit under Replacement lock cover €1000;
  • Introduction of a new exception 8 to the General exceptions section of our policy wording to make a clearer statement in our policy wordings of the indemnity process in the event of a claim involving an insured with an alcohol/drug level above the legal limit shown in the Road Traffic Acts.
  • Introduction of two new policy conditions 1 (e) and (f) in the General Conditions section of our wording in respect of restrictions, conditions and limits attaching to a person's driving licence;
  • Extended General conditions relating to Cancellation, Fraud and Duty to take care;
  • Amend an existing exclusion (number eight) and introduce three additional exclusions under Section 1 - Loss of or damage to the vehicle;
  • Amendments to Section 4 - Endorsements namely to endorsements E29 - Optional no claim discount step-back, E52A - Optional Protected no-claim discount, E52B - Optional protected no-claim discount with step-back and E57 - Windscreen damage cover on third party, fire and theft policies.
  • Amendment to Section 5 - Breakdown Rescue wording in respect of the cover under the Towing benefit.

To fulfil our obligation under S.I No. 74 of 2007 Non-Life Insurance (Provision of Information) (Renewal of policy of Insurance) Regulations 2007 a Notice to Policyholders will be inserted in all your impacted Aviva customers Commercial Motor renewal invitation packs from 1st August 2019 for a twelve-month period. This is to inform the customer of the restrictions, if any, that are different, in the policy of motor insurance that is to be renewed, to those that apply to the policy of motor insurance that is in operation. Attached you will find a sample copy of that notice to policyholder insert (Appendix One), in respect of the Van Product (MZ) which summarizes in more detail these changes.

Updated stocks of policy booklets and Insurance Product Information documents (IPID'S) for all the impacted product lines will shortly also be available to order. You can also visit www.avivabroker.ie where a PDF of the new Van/Commercial Motor policy booklets containing the complete wording updates and a copy of each product information document will be available soon in the appropriate document store.
